Terms and conditions

These Terms and Conditions ("Terms") govern the junk removal and related services provided by SoCal Junkmen LLC ("SoCal Junkmen," "Company," "we," "us," or "our") to customers ("Customer," "you," or "your"). These Terms, together with any applicable estimate, work order, booking confirmation, invoice, or other written service agreement, constitute the agreement between SoCal Junkmen LLC and the Customer.
By requesting, booking, accepting, or using our services, you agree to these Terms.
1. Junk Removal Services
SoCal Junkmen LLC provides junk removal, hauling, cleanout, disposal, and related services for residential and commercial customers.
Services may include the collection and removal of items from a home, office, business, property, storage area, or other location designated by the Customer ("Premises").
The specific services, materials to be removed, pricing, and other job details may be described in an estimate, work order, booking confirmation, or invoice.
Any service outside the original scope may require Customer approval and may result in additional charges.
2. Estimates and Pricing
Any estimate provided before the job is based on the information available to us at the time, including descriptions, photographs, estimated volume, item types, accessibility, labor requirements, and other information supplied by the Customer.
Final pricing may change if:
The actual volume or quantity of materials differs from what was originally described.
Additional items are added.
Items require additional labor or special handling.
Access to the items is more difficult than originally disclosed.
Additional equipment or personnel are required.
The Customer requests additional services.
When reasonably possible, SoCal Junkmen will inform the Customer of material pricing changes before performing additional work.
Applicable taxes, fees, or other charges may be added where required by law or disclosed as part of the service.
3. Prohibited and Restricted Materials
SoCal Junkmen does not knowingly accept materials that we determine are unsafe, hazardous, illegal to transport, or prohibited under applicable laws or disposal facility requirements.
Prohibited or restricted materials may include, without limitation:
Hazardous chemicals
Gasoline or other fuels
Explosives
Certain paints, solvents, or chemicals
Medical or biohazardous waste
Radioactive materials
Certain batteries or compressed gas cylinders
Asbestos or asbestos-containing materials
Other hazardous or regulated substances
The Customer is responsible for accurately informing SoCal Junkmen about the contents and nature of the materials being removed.
We reserve the right to refuse any item that we reasonably believe is unsafe, prohibited, hazardous, or outside the scope of our services.
4. Customer Responsibilities
The Customer agrees to:
Provide accurate information regarding the items to be removed.
Disclose known hazardous or potentially dangerous materials.
Provide safe and reasonable access to the Premises.
Provide sufficient access for our employees, vehicles, and equipment.
Keep walkways and work areas reasonably clear.
Inform us about stairs, elevators, restricted parking, gated access, or other access limitations.
Secure pets and keep children away from active work areas.
Ensure that the Customer or another authorized adult is available when reasonably required.
Be reasonably available by telephone during the scheduled service period if questions or approvals are required.
The Customer is responsible for obtaining any permissions reasonably necessary for SoCal Junkmen to enter and perform services at the Premises.
5. Authority to Remove Property
The Customer represents and warrants that they:
Own the items being presented for removal; or
Have full legal authority from the owner to authorize their removal.
The Customer must not request the removal of property belonging to another person without appropriate authorization.
SoCal Junkmen may refuse to remove an item when ownership or authority is disputed or reasonably uncertain.
6. Right to Enter and Access the Premises
The Customer represents that they own the Premises or have authority from the property owner to permit SoCal Junkmen to enter and perform the requested services.
The Customer authorizes SoCal Junkmen personnel to enter the areas reasonably necessary to retrieve and remove the designated materials.
If the Customer requests that our vehicles or equipment travel over lawns, gravel, unpaved areas, private driveways, or other surfaces not ordinarily intended for such use, the Customer acknowledges that those surfaces may present additional risks.
SoCal Junkmen may decline to drive or operate equipment in any area we consider unsafe or likely to cause unreasonable damage.
To the extent permitted by law, SoCal Junkmen will not be responsible for damage resulting solely from access specifically requested or directed by the Customer over unsuitable surfaces, except to the extent caused by our negligence, gross negligence, or willful misconduct.
7. Difficult or Extraordinary Access
Additional charges may apply when removal requires services materially beyond what was reasonably anticipated, including:
Difficult access
Excessive carrying distances
Large numbers of stairs
Disassembly
Heavy or oversized items
Special equipment
Additional personnel
Unusual disposal requirements
We will attempt to communicate material additional charges before performing work outside the originally agreed scope.
8. Ownership and Disposal of Removed Items
Once the Customer has authorized removal and SoCal Junkmen has taken possession of an item, ownership of that item may transfer to SoCal Junkmen to the extent permitted by law.
SoCal Junkmen may determine the appropriate method of handling removed materials, including disposal, recycling, donation, resale, reuse, or transfer to another facility or organization.
Customers should carefully inspect all items before removal.
The Customer is responsible for ensuring that personal documents, valuables, money, jewelry, electronic devices, photographs, identification documents, or other items they wish to retain are not included with the materials designated for removal.
9. Items Removed by Mistake
The Customer is responsible for identifying exactly which items should and should not be removed.
Once an item has been removed from the Premises, we cannot guarantee that it can be located or recovered.
If the Customer believes an item was removed by mistake, they should contact us immediately.
We will make reasonable efforts to assist when practical, but recovery cannot be guaranteed.
10. Pets, Children, and Work Area Safety
For the safety of customers, employees, pets, and others, pets should be secured away from the active work area while services are being performed.
Children and other individuals not involved in the service should remain at a safe distance from moving equipment, vehicles, and materials.
SoCal Junkmen may pause or discontinue work if conditions at the Premises create an unreasonable safety risk.
11. Scheduling and Arrival Times
Appointment dates and arrival windows are estimates and may be affected by traffic, weather, previous jobs, equipment issues, disposal facility delays, emergencies, and other circumstances outside our reasonable control.
We will make reasonable efforts to notify the Customer of significant scheduling changes.
12. Cancellations and Rescheduling
Customers should notify SoCal Junkmen as soon as reasonably possible if they need to cancel or reschedule an appointment.
Any cancellation, rescheduling, trip, deposit, or other applicable fee will only apply if it was disclosed to the Customer as part of the booking, estimate, work order, or invoice, or is otherwise permitted by applicable law.
13. Payment
Payment is due according to the terms provided in the applicable estimate, booking confirmation, work order, or invoice.
The Customer agrees to pay all authorized charges for services performed.
Payments may be processed through third-party payment processors.
Applicable taxes and legally permitted fees may be added when required.
Failure to make payment when due may result in collection activity or suspension of future services, subject to applicable law.
14. Estimates, Invoices, and Electronic Records
The Customer agrees that estimates, invoices, receipts, booking confirmations, and other service-related records may be provided electronically, including by email or text message where the Customer has provided appropriate consent.
Electronic copies of these documents may be treated as valid business records to the extent permitted by law.
15. Service-Related Communications
When a Customer requests or books services, SoCal Junkmen may communicate with the Customer through the contact information voluntarily provided.
Communications may include matters relating to:
Quote requests
Scheduling
Appointment confirmation
Arrival coordination
Service questions
Estimates
Invoices
Payment
Receipts
Customer support
Follow-up relating to requested services
Marketing or promotional text messages will not be sent based solely on consent to receive service-related SMS communications unless separate consent is obtained where required.
16. SMS/Text Messaging Terms
SoCal Junkmen LLC offers text messaging to customers who voluntarily opt in to receive service-related communications.
Customers may opt in by providing their mobile phone number and affirmatively selecting the applicable SMS consent option on our website, booking form, or another approved opt-in method.
SMS communications may include:
Appointment confirmations
Scheduling updates
Arrival notifications
Quote or estimate information
Service-related updates
Payment reminders
Receipts
Customer support communications
Message frequency varies based on your service activity.
Message and data rates may apply.
Reply STOP to unsubscribe from text messages at any time.
After receiving a valid opt-out request, we will stop sending applicable text messages to that mobile number except where a message is legally permitted or required.

Consent to receive text messages is voluntary and is not a condition of purchasing any goods or services.
Carriers are not liable for delayed or undelivered messages.
Your mobile information will not be sold or shared with third parties or affiliates for their marketing or promotional purposes.
Text messaging originator opt-in data and consent will not be shared with third parties or affiliates for marketing or promotional purposes.
We may use service providers that assist us with communications, customer service, scheduling, CRM operations, or text message delivery, but such providers may only process information as necessary to provide services on our behalf and subject to applicable contractual and legal requirements.
SMS consent is collected separately from unrelated consent or agreements whenever required.

17. SMS Opt-Out and Help Requests
Customers may opt out of applicable text messages at any time by replying:

We may also recognize additional standard opt-out keywords depending on our messaging provider and messaging configuration.
Opting out of text messaging does not prevent the Customer from receiving necessary communications through another channel, such as telephone or email, when permitted by law and reasonably necessary to provide requested services.
18. No Sale of SMS Consent
SoCal Junkmen does not sell, rent, or transfer SMS opt-in consent or mobile telephone information to third parties or affiliates for their own marketing or promotional purposes.
SMS consent cannot be transferred to another business for independent marketing purposes.
19. Privacy
Our collection and use of personal information is governed by our Privacy Policy.
The Privacy Policy explains the types of information we collect, how information is used, how information may be shared, data retention, customer choices, and our practices relating to SMS consent.

20. Damage and Liability
SoCal Junkmen will use reasonable care when performing services.
The Customer should identify fragile areas, existing damage, sensitive surfaces, concealed utilities, or other conditions that could reasonably affect performance of the services before work begins.
To the maximum extent permitted by applicable law, SoCal Junkmen is not responsible for:
Pre-existing damage.
Damage caused by defective, unstable, deteriorated, or unsafe property conditions.
Damage caused by inaccurate or incomplete information provided by the Customer.
Loss involving items the Customer mistakenly designated or allowed to be removed.
Damage resulting from prohibited or undisclosed hazardous materials.
Damage resulting solely from access routes specifically directed by the Customer that were unsuitable for normal service operations.
Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.
21. Customer Indemnification
To the extent permitted by applicable law, the Customer agrees to be responsible for claims, losses, or expenses resulting from:
The Customer's lack of authority to authorize removal of property.
The Customer's intentional or materially inaccurate representations about the items or Premises.
Undisclosed hazardous or prohibited materials.
The Customer's violation of applicable law or the rights of another person.
This provision does not require the Customer to indemnify SoCal Junkmen for losses caused by SoCal Junkmen's own negligence, gross negligence, willful misconduct, or other liability that cannot legally be waived.
22. Limitation of Liability
To the maximum extent permitted by applicable law, SoCal Junkmen will not be liable for indirect, incidental, special, exemplary, or consequential damages arising from the services.
This limitation does not apply where such limitation is prohibited by law.
Nothing in these Terms limits any non-waivable consumer rights or remedies available under applicable law.
23. Events Outside Our Reasonable Control
SoCal Junkmen will not be responsible for delays or inability to perform services caused by events reasonably outside our control, including severe weather, natural disasters, fires, government actions, road closures, labor disruptions, equipment failures, disposal facility closures, public emergencies, or similar circumstances.
We will make reasonable efforts to communicate and reschedule affected services.
24. Third-Party Services
SoCal Junkmen may use third-party service providers for functions such as:
Payment processing
Scheduling
Customer relationship management
Email delivery
SMS delivery
Website hosting
Analytics
Accounting or administrative services
Use of those services may also be subject to the applicable provider's terms and privacy practices.
Our use and sharing of customer information remains subject to our Privacy Policy and applicable law.
25. Website Use
Content on the SoCal Junkmen website is provided for general information regarding our company and services.
Users may not intentionally:
Interfere with website operation.
Attempt unauthorized access to website systems.
Introduce malicious software.
Use the website for fraudulent or unlawful purposes.
Copy or misuse protected content in violation of applicable intellectual property laws.
26. Intellectual Property
Unless otherwise stated, website content, business names, logos, graphics, photographs, text, and other materials created or owned by SoCal Junkmen remain the property of SoCal Junkmen LLC or their respective licensors.
Nothing in these Terms transfers ownership of our intellectual property to the Customer.
27. Compliance With Law
Both SoCal Junkmen and the Customer are expected to comply with applicable federal, state, and local laws relating to the services.
We may decline or discontinue a service request when we reasonably believe completing the service would violate applicable law, create an unreasonable safety risk, or require handling materials we are not permitted to accept.
28. Governing Law
These Terms will be governed by the laws of the State of California, without regard to conflict-of-law principles, except where applicable federal law or other mandatory law controls.
Nothing in these Terms limits any rights that cannot legally be waived under applicable consumer protection laws.
29. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.
The invalid provision will be interpreted or modified only to the minimum extent necessary to make it enforceable where permitted.
30. No Waiver
Failure by SoCal Junkmen to enforce any provision of these Terms on one occasion does not waive our right to enforce that provision or another provision in the future.
31. Changes to These Terms
We may update these Terms from time to time to reflect changes in our services, business practices, technology, or legal requirements.
Updated Terms will be posted on our website with a revised effective date.
Changes will apply prospectively unless otherwise required or permitted by law.
32. Entire Agreement
These Terms, together with the applicable estimate, booking confirmation, work order, invoice, Privacy Policy, and any other written agreement specifically applicable to the service, constitute the agreement between SoCal Junkmen and the Customer regarding the applicable services.
If a service-specific written estimate, work order, or invoice contains terms that conflict with these general Terms, the service-specific document will control with respect to the specific commercial terms of that job, to the extent permitted by law.
